These Terms constitute a legally binding agreement between you and Gifted Intuitions, LLC.
If you are using our website or services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and your agreement to these Terms will be treated as the agreement of the organization.2. DESCRIPTION OF SERVICES
A. Gifted Academy
We provide personalized educational consulting, homeschool setup and support, academic coaching, tutoring services, and full-time virtual teaching for K-12 students. Our educational services are designed to support students and families in achieving their academic goals through customized guidance and instruction.
B. Gifted Consulting
We offer communication strategy, branding, and messaging services tailored for non-profit organizations, faith-based organizations, community leaders, and other clients seeking to enhance their outreach and impact.
C. The GIFTED Collection
We operate an online shop that sells:
Digital Products: Downloadable items including printable lesson plans, workbooks, journals, educational resources, and other digital materials.
Physical Goods: Apparel, home decor items, custom-branded merchandise, and other tangible products.
D. Additional Services
Our founder is available for booking as a professional speaker and singer for events, conferences, workshops, and other occasions.

We do not guarantee specific results, outcomes, or improvements from the use of our services or products. Educational and consulting services are customized based on individual needs, but results will vary depending on numerous factors including individual effort, circumstances, and external variables beyond our control. Clients and customers are encouraged to seek appropriate professional guidance when necessary.3. ELIGIBILITY

All content, materials, and intellectual property on our website and in our products and services — including but not limited to text, graphics, logos, images, photographs, videos, audio files, software, code, design elements, lesson plans, workbooks, journals, branding materials, and other creative works (collectively, "Content") — are the exclusive property of Gifted Intuitions, LLC or our licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
Trademarks
"Gifted Intuitions," "Gifted Academy," "Gifted Consulting," "The GIFTED Collection," and all associated logos, service marks, and trade names are trademarks or registered trademarks of Gifted Intuitions, LLC. You may not use any of our trademarks without our prior written permission.
Proprietary Frameworks
The following named frameworks, methodologies, and systems are the exclusive intellectual property of Gifted Intuitions, LLC and may not be reproduced, taught, licensed, or referenced commercially without written authorization:

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use our website and services for your personal, non-commercial use only. This license does not include any right to reproduce, distribute, display, perform, or create derivative works from our Content without our express written permission; use our Content for commercial purposes or public display; modify, reverse engineer, decompile, or disassemble any software or technology on our website; or remove, alter, or obscure any copyright, trademark, or other proprietary notices from our Content.
Digital Products
When you purchase digital products from The GIFTED Collection, you receive a limited, personal, non-exclusive, non-transferable license to use the digital product solely for your own personal or educational use. This license does not grant you ownership of the digital product or any intellectual property rights therein. You may not resell, redistribute, share, or transfer the digital product to any third party; modify, adapt, or create derivative works from the digital product; or use the digital product for commercial purposes without our express written consent.
AI-Generated Content
Gifted Intuitions, LLC produces original AI-generated images, video content, and digital representations as part of its professional brand and product catalog. These works are the exclusive intellectual property of Gifted Intuitions, LLC regardless of the tools or platforms used in their creation, as they are the direct result of original creative direction, prompt authorship, and editorial judgment by Gifted Intuitions, LLC.
AI-generated images produced under the Gifted Intuitions brand may not be reproduced, downloaded, or used in any format without written permission. The digital AI twin and avatar of Antionette Manokey, M.Ed. — including voice, likeness, and presentation style — may not be replicated, impersonated, used in another production, or referenced in any way that implies endorsement without written authorization. Prompt engineering, creative briefs, and production direction used to generate AI content are proprietary and are not transferable to any third party. Co-produced AI content created for clients retains Gifted Intuitions, LLC copyright in the production work; clients retain rights only as specified in their individual agreements.
Video Productions and Footage
All video content produced by Gifted Intuitions, LLC — including raw footage, edited productions, short-form content, and long-form documentary work — is protected under copyright law from the moment of creation.
Authorized licensees and co-licensing partners are bound by their individual licensing agreements and may not transfer, sublicense, or donate footage rights to any third party; submit footage to archives, digital libraries, or collections without a separate written agreement with Gifted Intuitions, LLC; use footage for commercial purposes beyond the scope of their specific license; or extract still frames for use in print, digital, or broadcast media without written approval.
Third-party requests for access to footage — including from historical societies, preservation organizations, municipal archives, universities, or media outlets — must be directed to Gifted Intuitions, LLC for separate licensing review. No authorized party may negotiate or grant footage access on behalf of Gifted Intuitions, LLC.
Infringement
If you believe that any Content on our website infringes your intellectual property rights, please contact us immediately at [email protected] with detailed information about the alleged infringement.5A. PERMISSION TO REPRODUCE
Any use of Gifted Intuitions, LLC content beyond personal reference — including but not limited to publication, broadcast, archival deposit, inclusion in a collection, commercial reproduction, educational redistribution, or incorporation into any other work — requires a written Permission to Reproduce agreement executed with Gifted Intuitions, LLC prior to use.

Gifted Intuitions, LLC reserves the right to approve, deny, or negotiate terms for any reproduction request.5B. DIGITAL TAKEDOWN POLICY
Gifted Intuitions, LLC works to ensure all content published under its brand is used appropriately and that no third-party content is included without proper authorization.
If you are a rights holder and believe that content published by Gifted Intuitions, LLC violates your rights, please contact us with the following: your contact information (name, email address, and telephone number); the exact URL or location of the content in question; a description of the material and the basis of your rights claim; a good-faith statement that the use is not authorized by you, your agent, or by law; and a statement that the information provided is accurate and that you are the rights holder or an authorized representative.
Upon receipt, Gifted Intuitions, LLC will promptly acknowledge your request, assess the validity, and communicate appropriate action. Content may be temporarily removed from public view while under review.

All content published by Gifted Intuitions, LLC across any social media platform or third-party channel — including but not limited to Instagram, Facebook, YouTube (@LiveGIFTED), TikTok, Pinterest, LinkedIn, and any other platform where Gifted Intuitions, LLC maintains a presence — is the exclusive intellectual property of Gifted Intuitions, LLC and is protected under applicable copyright, trademark, and intellectual property laws.
The following apply to all social media and platform content:
Reposting and Redistribution: You may not screenshot, download, repost, share, or redistribute any content published by Gifted Intuitions, LLC on social media or third-party platforms without prior written permission, regardless of the platform's native sharing features.
Commercial Use: No content appearing on any Gifted Intuitions, LLC social media account or platform page may be used for commercial purposes, advertising, sponsorships, or paid promotions without a written licensing agreement with Gifted Intuitions, LLC.
Tagging and Attribution: Organic sharing with full credit and a direct link to the original source may be permitted for non-commercial, personal use only. Such sharing does not constitute a license and may be revoked at any time.
Platform Terms Do Not Override: The native terms of any social media platform do not grant any user the right to use, reproduce, or commercialize content belonging to Gifted Intuitions, LLC beyond what is expressly permitted in these Terms.
To request permission to share or use content from any Gifted Intuitions, LLC platform, contact [email protected].5D. LIKENESS, IMAGE, AND PERSONAL IDENTITY RIGHTS
The name, face, physical likeness, voice, signature, photograph, and personal identity of Antionette Manokey, M.Ed. ("Coach AJ") — in any format, medium, or context — are the personal property of Antionette Manokey and are exclusively licensed to Gifted Intuitions, LLC for business and brand use. No person, organization, platform, media outlet, or third party may use her name, image, likeness, or identity for any purpose without express written authorization from Gifted Intuitions, LLC.
This protection applies to, but is not limited to:
Photography and Images: Any photograph, screenshot, graphic, or digital image featuring Antionette Manokey may not be reproduced, edited, cropped, filtered, or used in any publication, advertisement, product, or promotional material without written permission.
Video and Audio: Any video recording, audio clip, podcast excerpt, live stream capture, or other recorded content featuring Antionette Manokey may not be repurposed, rebroadcast, remixed, or used out of context without written authorization.
AI and Synthetic Media: No person may use images, audio, or video of Antionette Manokey to train artificial intelligence models, generate synthetic media, create deepfakes, or produce any AI-generated representation of her likeness or voice.
Endorsement and Affiliation: Her name, image, or likeness may not be used in any way that implies endorsement, affiliation, partnership, or sponsorship with any individual, brand, product, or cause without written authorization from Gifted Intuitions, LLC.
Unauthorized use of likeness or identity will be considered a violation of these Terms and may result in legal action.5E. THIRD-PARTY SELLING PLATFORMS
Gifted Intuitions, LLC sells products through a number of authorized third-party marketplaces and platforms, including but not limited to Payhip, Georgia Promise Marketplace, Amazon KDP, Lulu, Etsy, Gumroad, and Teachers Pay Teachers (TPT). All products listed on these platforms remain the exclusive intellectual property of Gifted Intuitions, LLC regardless of where they are purchased.
The following apply to all purchases made through third-party platforms:
Intellectual Property: Purchasing a product through any third-party platform does not transfer ownership of the underlying intellectual property. All copyrights, trademarks, and proprietary rights remain with Gifted Intuitions, LLC.
License Scope: The license granted upon purchase is identical to that described in Section 5 of these Terms — personal, non-commercial, non-transferable, and non-sublicensable — regardless of the platform through which the product was purchased.
Platform Terms: Each third-party platform may have its own terms of service governing the transaction. Those platform terms govern the transaction mechanics only and do not expand or alter the intellectual property rights or usage license granted by Gifted Intuitions, LLC.
Disputes: For product-related questions, refund requests, or concerns about content, buyers should contact Gifted Intuitions, LLC directly at [email protected] in addition to or instead of contacting the platform, as platform policies may differ from those outlined in these Terms.5F. CONNECTED WEBSITES AND LINKED PAGES
These Terms of Service apply to all websites, subdomains, linked pages, and web properties owned and operated by Gifted Intuitions, LLC, including but not limited to:

All content, materials, and intellectual property across these properties are covered by the protections outlined in Sections 5, 5A, 5B, 5C, and 5D of these Terms. Accessing any of these web properties constitutes acceptance of these Terms in full.
Any future subdomains, microsites, landing pages, or linked properties created by Gifted Intuitions, LLC will also be governed by these Terms unless a separate agreement is explicitly stated on that property.5G. LOW KEY ZOKEY™ AND THE ZOEVERSE™ — MINOR CREATOR PROTECTIONS
Low Key Zokey™ and The Zoeverse™ are original creative brands developed under the direction of Gifted Intuitions, LLC and featuring the creative work, name, likeness, and artistic output of a minor child. All intellectual property associated with these brands — including but not limited to original artwork, characters, stories, digital content, merchandise concepts, brand name, and visual identity — is the exclusive property of Gifted Intuitions, LLC and is additionally protected under applicable minor's rights and right of publicity laws.
The following apply specifically to Low Key Zokey™ and The Zoeverse™:
Artwork and Creative Output: All original artwork, illustrations, designs, and creative works produced under the Low Key Zokey™ or Zoeverse™ brand may not be reproduced, downloaded, printed, sold, or used in any format without written permission from Gifted Intuitions, LLC.
Likeness of the Minor Creator: The name, face, image, voice, and likeness of the minor creator associated with these brands are fully protected and may not be used, shared, published, or referenced in any context — commercial or personal — without the express written consent of Gifted Intuitions, LLC and the child's parent or legal guardian.
AI and Synthetic Media — Strict Prohibition: The creation of any AI-generated, synthetic, manipulated, or composite image, video, or audio featuring the likeness or creative work of the minor creator is strictly prohibited under any circumstances.

Commercial Exploitation: No artwork, content, or likeness associated with Low Key Zokey™ or The Zoeverse™ may be used for commercial gain, advertising, merchandise, or promotional purposes by any party other than Gifted Intuitions, LLC without a formal written licensing agreement.
Violations involving the minor creator's likeness or work will be treated with the utmost seriousness and may result in immediate legal action.6. PURCHASES, PAYMENTS, AND REFUND POLICY
Product and Service Orders
When you place an order for products or services through our website, you agree to provide accurate and complete information, including billing and shipping information. You represent and warrant that you have the legal right to use any payment method provided for the transaction.
Pricing and Availability
All prices are stated in U.S. dollars and are subject to change without notice. We reserve the right to modify prices, discontinue products or services, or correct pricing errors at any time. We make every effort to ensure that product descriptions, images, and pricing are accurate, but we do not warrant that such information is error-free.
Payment Processing
Payments are processed through secure third-party payment processors such as Stripe, PayPal, or other similar services. By making a purchase, you agree to the terms and conditions of the applicable payment processor. We do not directly collect, store, or process credit card or financial account information on our servers. Payment is due at the time of purchase unless otherwise agreed in writing.
Sales Tax
Sales tax will be added to orders where applicable based on your shipping address and local tax regulations.
Shipping
For physical goods, shipping costs and delivery times will be calculated at checkout based on the shipping method selected and your location. We are not responsible for delays caused by shipping carriers, customs processing, or events beyond our control. Risk of loss and title for physical goods pass to you upon delivery to the shipping carrier.
Refund Policy
All sales of digital download products are final and non-refundable. Once a digital product has been purchased and the download link has been provided, we cannot offer refunds, exchanges, or cancellations due to the nature of digital goods.
For consulting, educational, tutoring, speaking, and other service-based offerings, refund requests are considered on a case-by-case basis only if made prior to the commencement of service. Once services have begun, no refunds will be issued. Requests must be submitted in writing to [email protected] and must include a detailed explanation of the circumstances.
For physical goods, if you receive a defective, damaged, or incorrect item, please contact us within 14 days of delivery at [email protected] with photographic evidence. We will work with you to resolve the issue through replacement, exchange, or refund at our discretion. We do not accept returns of physical goods for reasons of buyer's remorse, change of mind, or personal preference.
Cancellation Policy
Scheduled appointments for consulting, tutoring, speaking, or other services may be rescheduled or cancelled with at least 48 hours' notice without penalty. Cancellations made with less than 48 hours' notice or no-shows may result in forfeiture of the session fee or scheduling deposit, at our discretion.7. USER CONDUCT AND PROHIBITED USES
You agree to use our website and services only for lawful purposes and in accordance with these Terms. You agree not to violate any applicable local, state, national, or international law or regulation; infringe upon or violate our intellectual property rights or the intellectual property rights of others; transmit any material that is defamatory, obscene, offensive, hateful, discriminatory, threatening, harassing, or otherwise objectionable; engage in any conduct that restricts or inhibits anyone's use or enjoyment of the website or services; use the website or services in any manner that could disable, overburden, damage, or impair our servers or networks; attempt to gain unauthorized access to any portion of the website, other user accounts, or computer systems; use any robot, spider, scraper, or other automated means to access the website without our express written permission; introduce any viruses, trojan horses, worms, logic bombs, or other malicious or technologically harmful material; impersonate any person or entity or falsely state your affiliation with any person or entity; or interfere with or disrupt the integrity or performance of the website or the data contained therein.
We reserve the right to investigate and take appropriate legal action against anyone who violates these prohibitions, including removing content, suspending or terminating accounts, and reporting users to law enforcement authorities.8. USER-GENERATED CONTENT
Certain areas of our website may allow you to submit, post, or transmit content, including comments, reviews, testimonials, feedback, or other materials ("User Content"). We reserve the right, but are not obligated, to monitor, review, edit, or remove any User Content at our sole discretion, for any reason, without notice.

9. DISCLAIMERS AND LIMITATION OF LIABILITY
Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR WEBSITE, PRODUCTS, AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. Educational and Consulting Services Disclaimer
OUR EDUCATIONAL CONSULTING, TUTORING, COACHING, AND RELATED SERVICES ARE DESIGNED TO PROVIDE GUIDANCE, SUPPORT, AND RESOURCES. WE DO NOT GUARANTEE SPECIFIC ACADEMIC OUTCOMES, TEST SCORES, ADMISSIONS RESULTS, OR OTHER MEASURABLE ACHIEVEMENTS. INDIVIDUAL RESULTS DEPEND ON NUMEROUS FACTORS BEYOND OUR CONTROL.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GIFTED INTUITIONS, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, PARTNERS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE OUR WEBSITE, PRODUCTS, OR SERVICES.
Limitation of Aggregate Liability
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT PAID BY YOU DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100.00), WHICHEVER IS GREATER.10. INDEMNIFICATION

PLATFORM-SPECIFIC TERMS
This website and services are delivered through the Carrd platform. By using our services, you acknowledge and agree that:
Dual Governance: These Terms govern our substantive services and business relationship, while Carrd's Terms of Use (available at carrd.co/terms) govern your use of the Carrd platform.
Platform Disputes: Any disputes, claims, or controversies arising from or relating to your use of the Carrd platform itself shall be resolved exclusively through final and binding arbitration in accordance with Carrd's Terms of Use.
Jurisdiction Coordination: For matters involving the Carrd platform, the governing law, jurisdiction, and venue provisions of Carrd's Terms of Use shall prevail.

Unless otherwise specified in the Platform-Specific Terms section above, these Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law principles.
Jurisdiction and Venue
You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Chatham County, Georgia. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.
Dispute Resolution
Before filing any legal action, you agree to first contact us at [email protected] to attempt to resolve any dispute informally. We will work with you in good faith to resolve disputes amicably. If we cannot resolve a dispute within thirty (30) days, either party may pursue formal legal remedies.
Waiver of Class Actions
TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.14. MODIFICATIONS TO TERMS
